SUBJECT: Appointment to the Central Okanagan West Advisory Planning
Commission (APC) (File: 0540-20-01)
RECOMMENDATION:
THAT Rick de Jong be appointed to the Central Okanagan West Advisory
Planning Commission for an additional two year term.
BACKGROUND:
It is noted that current membership for the Central Okanagan West
APC stands at the maximum of eight in accord with the APC Bylaw for
the Regional District. The APC bylaw allows each APC member to be
appointed for two year terms. The Bylaw requires that appointments
be endorsed by the Regional Board on advice from the Electoral Area
Directors. Mr. Jim Edgson, Central Okanagan West Electoral Area
Director is recommending that one existing member, Mr. Rick de Jong
be appointed for an additional two year term in recognition that the
current term expires January 28, 2010.
Planning staff of the Development & Environmental Services
Department is providing this for the information and consideration
of the Board.

Advisory Planning Commissions
The Regional Board has approved appointments to its Advisory
Planning Commissions. In Central Okanagan East, Don Stuart has been
appointed to the Advisory Planning Commission for a two year term
while Bob Calder, Wendy Schlief, Ted Thomas and Randy Woods have
been re-appointed for an additional two year term. In Central
Okanagan West, Ben Hansen has been appointed for a two year term to
the Advisory Planning Commission while Peter Austin, Don Bennison,
Norm McLeod and Helmuth Mitchell have been re-appointed for an
additional two year term. |

Governance & Services Committee Meeting Minutes – January 10,
2008 (Pg. 5 - 6)5.3 Fringe Area Planning The Administrator outlined the regional district’s policy past
practice for fringe area planning and the need for a change in
policy due to incorporation of the Westside. A draft report was submitted with options to consider for moving
forward. The City of Kelowna has stated they are interested in
participating in rural area planning in Joe Rich and Ellison as
it will affect their boundaries. Director Hanson has stated that she is not interested in fringe
area planning where the City of Kelowna would be in control of
decisions for Joe Rich and Ellison. Committee members voiced concern that without participation of
the municipalities there would be no feedback for a director and
that generally speaking it has been helpful to have more people
involved in the discussion. Without any participation from
municipalities taxes may be impacted for the electoral area. It was noted that the Westside Council has yet to discuss fringe
area planning. Staff confirmed that they would be willing to come and discuss
the issue with Council. From Peachland’s perspective, Council is interested in fringe
area planning with respect to Crystal Mountain, Brent Road and
Trepanier. Staff reviewed the Local Government Act (LGA) relating to
‘fringe area’ planning. The LGA states that a municipality will participate in planning
unless they opt out. It also states that
the
director for
the municipality is not entitled to vote on the resolution or
bylaw authorizing the regional district to enter into the
agreement. As soon as the agreement has been
entered into, the director for that municipality is not entitled
to vote on any resolution or bylaw authorizing the regional
district to enter into any other agreement under that section. It was noted that the City of Kelowna has opted out of the
regional planning function but agreed to fringe planning. The
District of Peachland opted in to fringe planning as well. It was noted that should the electoral area opt for no fringe
area planning the only directors who would vote on their
planning issues would be the electoral area directors.
The
benefit of having input from Kelowna was stated particularly
with involvement in the North Westside Advisory Planning
Commission. Director Edgson stated his support for fringe area
planning. It was stated that staff need to develop a foundation, including
past and present decisions, so that all directors understand
clearly how regional planning and fringe area planning works
within the regional district. As well staff need to review and
set revised boundaries for fringe area planning as with the
incorporation of the Westside boundaries have changed. CLARK/SHEPHERD THAT further discussion on Fringe Area Planning be postponed
until the next Governance & Services Committee meeting in order
for municipalities to review their options. CARRIED |

Staff reviewed the application.
Chair Hobson asked if there was anyone in the gallery who

Mr. Jim Edgson
addressed the Board as Chair of the Westside - North Advisory
Planning Commission. Although in support of the variance
application, the APC has asked him to recommend that the
Regional District put a process in place to prevent future
occurrences. It is suggested that a point of inspection be
added to the building inspection process to inspect footings
before concrete is poured.
After discussion, the Board advised that the Advisory
Planning Commission should put its request in writing to the
Director of Inspection Services for further review and
consideration.
#126/06 DINWOODIE/NOVAKOWSKI
THAT the Regional Board approve Development Variance Permit
application VP-06-01 for Ernie Marchinko (owner) located
adjacent to Westshore Road to vary RDCO Zoning Bylaw No.
871, s.7.1.4, by reducing the minimum front setback
requirement in the R1 Single Detached Housing zone from 4.5
metres (14.8 ft) to 3.69 metres (12.10 ft) in accordance
with the January 3, 2006 Site Improvement Survey, prepared
by Advanced Surveying Ltd.

Highlights of the Regional Board Meeting– May 3, 2004
McCulloch Lake Resort Acquisition
The Regional Board has received the results of the
Alternate Approval Process used for the agreements to
acquire McCulloch Lake Resort. While the signatures of
10% of electors were required to seek approval through
referendum, only four signatures were received. The
Regional District, Okanagan Boys and Girls Clubs and
South East Kelowna Irrigation District have formed a
joint venture, offering to purchase and manage the
resort. The offer requires Supreme Court approval. |

The Committee reviewed the regional park service. The
old policy required 4 out of 6 areas to agree to any
change. Due to changes to the Westside Electoral Area
there are now only five areas which requires the policy
to be changed.

THAT the following amendments to the Regional District
policy concerning tax rate limits for Regional Parks
Service be recommended to the Regional Board for
approval:
a) 75% of the total weighted vote of the Regional
District Board to be case in favour of the proposed
change; and
b) approval of 3/5 of the participants of the Regional
District Regional Parks Service to be in favour of the
proposed change. (In the case where a participant has
more than one representative, a majority of those
representatives voting in favour of the proposal is
approval).

Westside gets bill for rural area planning

March 26, 2009If Westside wants a say in development
outside its boundaries, there’ll be a small price to pay.
Development that happens in a rural area, immediately outside a
municipality, is called fringe planning.
If a municipality wants to vote on such development it is then
permitted to pay in to the regional district planning process.
Municipalities will often pay for fringe planning to ensure rural
developments, near their borders, don’t have negative impacts on
infrastructure, like roads or parks for example.
Westside’s fringe areas are considered Trepanier Valley, Crystal
Resort and parts of North Westside.
To vote on
development in those fringe areas, the municipality will have to pay
just under $6,000, according to a report submitted to the Central
Okanagan Regional District’s governance and services committee on
Thursday.
The regional district board must still vote on the report, however.
And rural area directors may yet express concern with the fringe
planning scheme.
That’s because municipalities carry more votes on the regional
board.
So, if a rural director was in favour of a development and a
municipality was not, the rural director could be outvoted.
There’s also debate around the board table as to whether that’s fair
seeing as how the rural areas have no jurisdiction to vote on
development inside municipalities and municipal representatives
aren’t elected to address rural matters.

Official community plan called for by CORD board

Good news for residents in three Central Okanagan neighbourhoods
where substantial development pressure has surfaced in the last two
years.
The Central Okanagan Regional District board has decided that
official community plans will proceed in June Springs and Lakeshore
Road South near Kelowna’s borders and Trepanier Valley between West
Kelowna and Peachland’s boundaries.
Several development applications have come forward in the areas over
the last two years but the board has often struggled on how to
proceed without a guiding planning document.
Official community plans will establish clear guidelines in the
areas for planning staff, developers, residents and the board alike,
said regional district development services director Dan Plamondon.
“In the case of the South Lakeshore area we’ve met with some
residents of the community who’ve asked us to look at developing an
official community plan because of the development pressures,”
stated Plamondon.
The board has shot down three different development proposals from
two different developers in the last two years in Lakeshore Road
South, because neighbours expressed vehement opposition and
environmental concerns were inadequately addressed, in the board’s
opinion.
An official community plan will better equip staff in overlaying
development applications with environmentally sensitive areas so the
board can get a clear picture of the impact, said Plamondon.
Official community plan processes will hopefully start in all three
rural areas in the second half of this year, Plamondon told the
regional board Monday night. The regional district is already
proceeding on a similar process in the vast North Westside rural
area, north of West Kelowna, across Okanagan Lake from Lake Country
and parts of Kelowna.
Meanwhile, the regional district will postpone a much broader
regional growth strategy, which looks at environmental,
transportation, affordable housing and sustainability issues for all
of the Central Okanagan.
Chairman Robert Hobson said the board felt it was best to finish the
official community plans first.
“It’s a bit of a chicken and egg debate as to whether one should do
an official community plan review or a regional growth strategy
first,” said Hobson.
In this case, the board also opted to wait because West Kelowna and
Kelowna were conducting their official community plan reviews too.
The regional growth strategy must be completed by 2012, according to
provincial legislation.
