To the editor:
Hi there Westsiders! Welcome to the new fiefdom of District of
Westside.
Following last year’s infamous referendum vote to go it alone, and
prior to our new civic elections, I submitted a letter for
publication to our various Kelowna newspapers, and I wish to
re-iterate its last paragraph:
“…In addition, with little or no tax and minimal infrastructure
revenues from the runaway developments on the First Nations
Reserves, the tax increases for Westside residents will be
astronomical. Fasten your seat belts folks, because we are in for
one of the wildest tax rides imaginable.”
For 2008, my net residential taxes have increased by a whopping 19.1
per cent over year 2007, and nothing has changed except my tax bill.
Just three more years of such piggish tax increases and I will be
paying 100 per cent more than in 2007.
Prophetic words, weren’t they?

Key Assumption Analysis
As there were no applicants the Committee moved to discuss the
Westside Governance Key Assumptions at this time.
It was noted that at last night’s Westside Governance meeting, as
requested from the Regional Board and the District of Peachland, the
Governance committee agreed to move the sewer treatment plant from
municipal to a regional service in the Key Assumptions. As well with
regard to Crystal Mountain, the Westside Governance
Committee recommended to the Ministry of Community Services and to
any future Westside municipal government that the Crystal Mountain
Ski Resort development be considered for future inclusion within the
municipal boundaries but will not change the boundaries for their
purposes of the study.
Currently Crystal Mountain is not included in the Regional
District’s OCP boundaries but the applicant has applied for an OCP
amendment and a zoning amendment for the first phase of development
on Crystal Mountain.
Concern was expressed regarding the remaining fringe areas on the
Westside if incorporation or amalgamation were to occur, for example
Brent Road. It was noted that a whole series of issues need to be
reviewed regarding boundary extensions and the
Regional District. The Regional District may wish to draw to the
attention of the Province that there may be difficulties and/or
opportunities regarding the remaining fringe areas before the vote.
It was noted that the Westside Governance Committee developed the
Key Assumptions with no input from the Regional District
The Westside Governance Committee will be dissolved in April and
there is no further opportunity to change the Key Assumptions. It
was noted that the Province is writing a draft Letters Patent.
It was suggested that the District of Peachland Council review their
options with regard to boundary extension and communicate with the
Regional Board.
CLARKE/SHEPHERD
THAT the Governance and Services Committee direct staff to prepare a
report to the Regional Board reporting that the Regional District’s
Governance & Services Committee has reviewed the Westside Governance
Committee’s Key Assumptions in Analysis and recommends that the
Regional Board advise the Minister of Community Services of the
following outstanding issues: Crystal Mountain--should be included
in any municipal structure; and unincorporated fringe
areas--discussion on how they should be structured and the number of
electoral areas.

5.3 Fringe Area Planning
The Administrator outlined the regional district’s policy past
practice for fringe area planning and the need for a change in
policy due to incorporation of the Westside.
A draft report was submitted with options to consider for moving
forward. The City of Kelowna has stated they are interested in
participating in rural area planning in Joe Rich and Ellison as it
will affect their boundaries.
Director Hanson has stated that she is not interested in fringe area
planning where the City of Kelowna would be in control of decisions
for Joe Rich and Ellison.
Committee members voiced concern that without participation of the
municipalities there would be no feedback for a director and that
generally speaking it has been helpful to have more people involved
in the discussion. Without any participation from municipalities
taxes may be impacted for the electoral area.
It was noted that the Westside Council has yet to discuss fringe
area planning.
Staff confirmed that they would be willing to come and discuss the
issue with Council.
From Peachland’s perspective, Council is interested in fringe area
planning with respect to Crystal Mountain, Brent Road and Trepanier.
Staff reviewed the Local Government Act (LGA) relating to ‘fringe
area’ planning. The LGA states that a municipality will participate
in planning unless they opt out.
It also states that the director for the municipality is not
entitled to vote on the resolution or bylaw authorizing the regional
district to enter into the agreement. As soon as the agreement has
been entered into, the director for that municipality is not
entitled to vote on any resolution or bylaw authorizing the regional
district to enter into any other agreement under that section.
It was noted that the City of Kelowna has opted out of the regional
planning function but agreed to fringe planning. The District of
Peachland opted in to fringe planning as well.
It was noted that should the electoral area opt for no fringe area
planning the only directors who would vote on their planning issues
would be the electoral area directors.
The benefit of having input from Kelowna was stated particularly
with involvement in the North Westside Advisory Planning Commission.
Director
Edgson stated his support for fringe area planning.
Director Baker arrived at 11:20 a.m.
It was stated that staff need to develop a foundation, including
past and present decisions, so that all directors understand clearly
how regional planning and fringe area planning works within the
regional district. As well staff need to review and set revised
boundaries for fringe area planning as with the incorporation of the
Westside boundaries have changed.

THAT further discussion on Fringe Area Planning be postponed until
the next Governance & Services Committee meeting in order for
municipalities to review their options.

The Westside–Kelowna boundary proposes downtown Kelowna be included
in a provincial riding with the District of Westside and parts of
Central Okanagan West electoral area. Kelowna’s Mayor
Sharon Shepherd is unhappy with a recommendation that Westside and
downtown Kelowna be joined in a new provincial riding.
“Westside is a separate entity that is very different from (us),”
said Shepherd. “It would be difficult for someone (an MLA) to
represent both communities on opposite sides of the lake, with very
different needs.”
A riding spanning the lake would have made more sense if
amalgamation had occurred, said the mayor.
The B.C. Electoral Boundary Commission seemed to have envisioned
that outcome when it first recommended the riding, added Shepherd.
The Kelowna mayor saidher council will consider writing to Premier
Gordon Campbell, asking him to reject the commission’s decision.
“Obviously it’s disappointing the commission didn’t take in to
account our proposal,” said Shepherd.
Kelowna had made a presentation to the commission last month,
recommending the east side of the lake, including Lake Country and
Ellison, be given three MLAs.
Growth projections for the next eight years strengthened the city’s
position, said the mayor.
She added a number of Westside residents submitted e-mails to the
commission’s website opposing a riding shared with Kelowna.
“We thought that also strengthened our case.”
The District of Westside did not make it’s own submission to the
boundary commission.
The municipality had more pressing matters to deal with, said Mayor
Rosalind Neis. She noted the boundaries would shift again in the
future as the Okanagan’s population continued to grow.
In creating the Westside–Kelowna riding, the commission has also
recommended Peachland move in to the Penticton riding.
Peachland Mayor Graham Reid said his community was part of a riding
with Penticton eight years ago before the current Okanagan–Westside
riding was created.
Reid said his council realized that in order to make the population
count work in each riding, Peachland would need to be included with
Summerland and Penticton.
“To make it work Peachland would have to move south,” said Reid.
“But, it’s not so much about what riding you’re in. It’s more about
how you are represented by your MLA.”
The current riding is represented by Small Business and Revenue
Minister Rick Thorpe.
Reid commended the minister for the hard work he had done on
Peachland’s behalf in the last four years. Peachland received three
major grants last year, with the MLA’s assistance he stated. One for
a water treatment system. The other two were for parks improvements.
As for Kelowna’s contention that it shouldn’t be sharing an MLA with
Westside, Reid said the city should be content with the fact the new
configuration would still see three MLA’s representing the city. |

Here’s what the B.C. Electoral Boundary Commission proposes

In making its submission to the B.C. government last week, the
Electoral Boundary Commission presented a case for a new
Westside–Kelowna riding.
The riding would encompass the District of Westside and downtown
Kelowna, including Kelowna City Hall, and parts of Central Okanagan
Westside, such as the two Westbank First Nation reserves and other
land from the Okanagan Connector in the south to Fintry in the
north.
“We propose that the Kelowna–Westside electoral district be named
Westside–Kelowna to reflect that the majority of the population is
in the municipality of Westside,” said the commission in its report.

Westside neighbourhood wants back into riding

A Central Okanagan subdivision has been left off the map proposed for the new
Westside-Kelowna riding.
Five hundred residents of West Shore Estates are feeling they‘re on the wrong
side of the northern border of the riding proposed by the province‘s Electoral
Boundaries Commission.
According to government documents, the renamed riding of Westside-Kelowna
extends north to Killiney Beach, a community on Okanagan Lake about eight
kilometres south of West Shore Estates.
“The government seems to forget that West Shore Estates is even here. We‘ve been
here 20 to 25 years,” said Allastair Fergusson, president of the North Westside
Ratepayers Association.
“It‘s not uncommon. We‘re an unknown entity out here. We‘re kind of in a
no-man‘s land.”
The 200-home subdivision is part of the Central Okanagan regional district,
which collects taxes from the residents and enforces its bylaws there, Fergusson
said. The way the proposed boundaries are drawn now, West Shore Estates is
located in the Shuswap electoral district instead.
Fergusson has reported the apparent error to the office of Kelowna-Westside MLA
Rick Thorpe and to Jim Edgson, regional director of the Central Okanagan West
electoral area.
“It was a mistake,” Edgson said Sunday. “The proposed boundary is just below the
boundary of the Okanagan Indian Band. That means it‘s the same northern boundary
that has existed for the last few years.”
Proposed changes to the riding boundaries have upset Kelowna Mayor Sharon
Shepherd. She‘s unhappy the suggested eastern boundary would cross the lake and
absorb a prime slice of downtown Kelowna, home to about 17,000 residents.
Shepherd wants city council to lobby the province for a third MLA in Kelowna to
reflect the city‘s projected growth.

Chunk of Kelowna to vote with Westside

The numbers just didn‘t add up for a provincial commission, so downtown Kelowna
voters will help select a new Westside MLA and Peachland voters will direct
their attention south to Penticton.
Kelowna Mayor Sharon Shepherd, unhappy with the commission‘s final decision,
will suggest city council lobby the government directly for a third MLA in
Kelowna.
On Wednesday, the B.C. Electoral Boundaries Commission released its final
report, which will be reviewed and decided by the provincial legislature.
The key recommendation in the Central Okanagan is separating 17,015 downtown
residents from the Kelowna-Mission and Kelowna-Lake Country ridings to become
part of Westside-Kelowna, the renamed Okanagan-Westside riding.
The commission also decided the southern boundary of Westside-Kelowna would be
slightly adjusted to the boundary of the new Westside municipality rather than
the Okanagan Connector.
The original name last summer was Kelowna-Westside, but since most of the voters
will be on the Westside, the name was reversed in the final report.
“In dealing with the boundary-setting process, at some point cities like Kelowna
are too big to have just one (MLA). They are not the right population to be
divided into nice numbers and so a challenge to an electoral boundaries
commission is how do you try to even it out throughout a region including cities
like Kelowna,” said commission member Stewart Ladyman during a conference call.
The result is a smaller number of people in Kelowna being combined with a larger
number of people on the Westside, he explained.
“That‘s not what the mayor of Kelowna suggested to us at our public hearing, but
you just can‘t create parts of electoral districts just to satisfy civic or city
boundaries,” said Ladyman.
Shepherd used population growth figures from the city‘s official community plan
to show Kelowna-Mission (50,900), Kelowna-Lake Country (52,000) and a new riding
of Kelowna Centre (50,700) would be within the 25 per cent deviation from the
provincial average allowed in legislation.
Peachland, which has closer ties with Westbank than Penticton, would even out
the population of the new Westside-Kelowna riding.
“Our worry is that it‘s eight years before you even have an opportunity to
review it again. Obviously, we are in support of having another member represent
part of our community, but we were really concerned that it was going to be
difficult for people to identify who represents them on provincial issues when
you‘ve got a split electoral district,” said Shepherd.
“I don‘t think that we quit at this point in time. I certainly would be
suggesting (to city council) sending a letter off to the premier with the
information and asking him to review it before they make the final decision on
the boundaries. I felt we had a very good case.”
The city may have erred in not making the argument for three MLAs based on
growth projections during the commission‘s first tour of the Okanagan, since the
hearings this winter were the final go-round, and all of the riding boundaries
had been set, she said.
Peachland did not attend, which would have supported the city‘s case.
Peachland Mayor Graham Reid said Thursday his council understands the necessity
to balance the size of ridings to meet the provincial average.
“Peachland had been part of that Penticton riding before, and now we‘re moving
back again. The importance for Peachland is not so much which area you are in,
but how good your representation is from your MLA,” he said.
Provincial grants have been very important for Peachland, and Okanagan-Westside
MLA Rick Thorpe has “worked very hard for Peachland,” he said.
“We would expect that any MLA who might represent that area in the future,
depending on how that shakes out, would work as hard for Peachland as Minister
(of Small Business) Thorpe does.”
The renamed riding of Westside-Kelowna extends north to Killiney Beach (*Note -
this part was a mistake says Allastair Fergusson from the Ratepayers
Association. Allastair believes the boundary is really at Westshore
Estates at the OKIB reserve), the
current boundary of Okanagan-Westside, and south generally to the Okanagan
Connector.
In Kelowna, the Westside-Kelowna boundary follows Trench Place, High Road,
Glenmore Drive and Harvey Avenue, encompassing downtown Kelowna.

North Westside area contemplates future

North Westside Road residents are considering their future, and that
could include joining a northern neighbour.
The North Westside Ratepayers Association suggests the area on the west
side of Okanagan Lake — from Westshores to Fintry — should form its own
municipality or become part of the Township of Spallumcheen.
President Allastair Fergusson said his group decided to tackle the issue
because of the valley-wide governance review initiated by the provincial
government.
“Instead of being told where to go, let’s be proactive and decide where
we should go,” he said.
Currently, the North Westside is part of an electoral area within the
Kelowna-based Central Okanagan Regional District.
The association’s plan is to have a town hall meeting in the spring so
residents can discuss the matter further.
But at this time, Fergusson is leaning towards joining Spallumcheen if
governance has to change.
“We are a rural district and so is Spallumcheen,” he said, adding that
the township has a council and administrative structure already in
place.
He isn’t keen on the North Westside becoming a municipality because it
has just over 2,000 residents.
“I hesitate to go that way because our taxes would probably triple by
the time we are done,” he said.
Spallumcheen Mayor Will Hansma says his council has not discussed the
prospect of extending its borders along Okanagan Lake.
“But it’s not an unreasonable request,” he said.
“It would be an additional source of tax revenue which is not a bad
thing.”
Spallumcheen covers a vast area from Enderby to the Spallumcheen Golf
and Country Club and over to the Salmon River Valley.
It is physically separated from the North Westside Road area by the
Okanagan Indian Reserve but Hansma doesn’t believe that is a concern.
“It’s nothing that can’t be overcome,” he said.
Jim Edgson, North Westside director, isn’t willing to take sides on the
issue yet.
“I want to get all of the information on all of the options available so
residents can make a decision,” he said.

government about a governance review for the North Westside. |
